Privacy Impact Assessments remain the best policy tool for programs to identify, assess and implement privacy requirements. This session will provide a very brief background on privacy and PIAs (30 minutes, tops) and plunge head first in to case studies in small groups to learn how to do a PIA. You'll be able to pick from a variety of case studies so the exercise is most useful to you. Lots of time for questions, sharing problems and identifying solutions.

Tracy Ann Kosa is the Team Lead of the Government of Ontario's PIA Centre of Excellence. The COE undertakes assessments, training, design and RFP support to enable privacy compliance across the Ontario Public Service's 600+ programs. Part of the Information Privacy and Archives Division, the COE is placed in the Policy and Planning Branch and works closely with the Policy Research and Issues Management unit to provide advice and guidance on implementing privacy requirements. Tracy is also a doctoral candidate in Computer Science, developing a metric for measuring privacy.

One of the most popular sessions at the last 3 iterations of the PHIPA Summit, this basics presentation has been transformed into a hands-on workshop that will provide an overview of the obligations on health information custodians with respect to the collection, use, disclosure, protection, retention, transfer and disposal of personal health information. An explanation of how and from whom custodians can obtain knowledgeable consent, and the circumstances under which personal health information can be collected, used and disclosed without consent and with implied or express consent will be briefly reviewed. Finally, the most significant orders under PHIPA will be summarized.

Lonny is a partner of the law firm Rosen Sunshine LLP, which he founded with his partner Elyse Sunshine in October 2011. Rosen Sunshine is a boutique health law firm, which is focused on providing expert counsel and practical advice in a wide variety of matters related to health law.

Lonny is certified by the Law Society of Upper Canada as a Specialist in Health Law. His practice consists of providing opinions and advice with respect to health care legislation and policies, and representing clients in a wide range of civil and administrative proceedings. Lonny regularly represents health professionals in complaint and discipline matters, investigations, audits and peer reviews, hospital privileges disputes, and in hearings before the Consent and Capacity Board and other health tribunals. Lonny advises clients on a wide variety of health law issues, including with respect to privacy, the delivery of private health care and other aspects of practice management, and consent, capacity and mental health issues. His clients include health care professionals, administrators of health care facilities, professional associations, and individuals.

Lonny is a leader of the health law bar, having served as Chair of the Health Law Sections of both the Canadian (CBA) and Ontario (OBA) Bar Associations, and now serving as a member of the governing council of the Medico-Legal Society of Toronto and of the Executive of the CBA Health Law Section. Lonny also serves as a member of the Hospital for Sick Children’s Research Ethics Board and of the Canadian Hospice Palliative Care Association's Advance Care Planning Task Group. Lonny frequently writes and speaks on health law issues, including as a faculty member for Osgoode Professional Development’s Certificate Programs in Health Law and Mental Health Law and for various Law Society and OBA Programs.
